What about the legality of this advertisement ?
It depends on what Mario the billboard is talking about. One ad for the racing game Nigel Mansell's World Championship (for Super NES, Genesis, and Game Boy) had "Nigel Beats Mario*" in big letters. Can you translate the French at the bottom so I have an idea of what they're selling?

The text doesn't say much it seems... "Our customers are the best! We thank our 2613377 customers for their confidence in 2009." doesn't help in figuring out what they sell. Since they are called "PostFinance" it probably has something to do with banking, loans, stuff like that.
Well I'm not really sure what they're advertising here, it's something about the post. I don't know if this ad was supposed to make people send more letters, or if they hope people will open bank accounts in the post. Anyway it's really a weird ads (there is some with other non-Nintendo related surnames word-jokes as well).
If you drive US40 through Brazil, Indiana you will see a mexican restaurant called Mario Bros. Their sign is in the same multi-colored font as Super Mario World.
Not the same font, but the colors make it look like SMW. Also, LOL at the US having a city named Brazil.
Northern Indiana alone has Peru, Chili [sic], and Mexico, all close to U.S. 24. (I smell split soon.)
