This thread isn't some great debate as to the ethics of prototype owning/distributing. If you read back through the two pages so far it's filled with post of "This is awesome!" There's very little mention of the rom at all actually.
It sounds as though Frank plans on releasing the rom at some point. Great. No community dump, no reproductions, no hording, etc. It's a scenario that everyone can be happy about.
The entire reason that this prototype is particular interest is because of the hoax and the debate between dumping it/hoarding it. The point being that TheRedEye has done countless releases of unreleased NES (and via my site SNES) games out of his own pocket, without asking for a dime. This game will be released for free eventually, probably after a proper article is written on Lost Levels. And really, that is the way it should be, to preserve the unusual history of this game before it becomes a footnote in a GoodNES ROM set torrent. Bio Force Ape appears to have been a potential AAA title for the NES, and should be well documented.

I'm pretty sure the game was being developed in Japan, which would be the reason why it was found in Japan.
