The legality is certainly not clear. They aren't just distributing roms, they have physical cartridges to back up every rom. Their system keeps track of how many of each game is currently being used and doesn't let that number get above how many they physically have. Once you close the app, the rom is gone from your computer. It is pretty much like a video rental place, except the delivery is electronic.

Wow, I've always wondered about the legality of doing this - having a virtual sharing system whereby someone has a license for something, say a game or music, and they lend it out to their 'friends' online when they arn't using it. This way everyone shares the 1 resource but it isn't in use by more than 1 person at a time. Sound dubiously legal...I had thought of the idea, never knew anyone had actually done it
