If they did make an N64 mini for real, Rare titles would actually be possible depending on if they worked things out with Rare, as they seem to be slightly more open to working with them and Microsoft lately. If Banjo can be in Smash Bros, then Rare titles can be on N64 mini. IF they did get Rare on board I'd expect Banjo-Kazooie, Diddy Kong Racing, jet Force Gemini, Perfect Dark and Donkey Kong 64. I'd love to see Banjo Tooie and Conker on there but for some reason I feel like they wouldn't put a 2nd Banjo game on there and they wouldn't put Conker because it's too "mature" or whatever. But realistically it would most likely be without the Rare titles.

The missing Rare titles would certainly suck, but they could go entirely with first party games and still have enough good titles to justify approximately $80 to $100.
The biggest issue would certainly be the controller, and how they would want to realistically handle extra controllers.
N64 controllers I'd imagine they'd have the same design as the originals and same size, but HOPEFULLY they'd be smart enough to not use the exact same type of joystick. Maybe at least fix the major flaw of the control sticks so they don't break so easily.
