"Factory" sealed game from Amazon a bust Anyone else been in this situation?

So I was perusing Dain's kick ass Anaea tool looking for some deals on Amazon and spotted a very cheap factory sealed Stanley: The Search for Dr. Livingston, so I snatched it up for $2.99 plus shipping.  Not a bad deal at all as the description read "nes game - brand new, factory sealed. satisfaction guaranteed!".

Fast forward a week or so and this arrives at my door:

Before I even got it out of the bubble mailer (yup, bubble mailer too), I could see the obvious corner wear on the box underneath the cellophane.  By the time I got it out of the mailer and noticed it was missing the horizontal seal, I was pretty disappointed.  Has anyone ever been in this situation from a purchase on Amazon?  How did you go about getting it resolved?  The seller was Titangames which sounds oddly familiar, is this someone known for resealed stuff?  any help would be appreciated guys!

I'd just keep it.  Thats still a steal for $2.99 + shipping.

That is what I was thinking, maybe I'll open it and make sure that the game is actually in there.  I contacted the seller, they have solid feedback so I'm hoping that they are reasonable.

Ask them for a partial refund for your trouble
