It's the other way around for why the get arrested. They get arrested for sharing, not downloading.

yup! once people are downloading FROM you, the violation of copyright law becomes an issue.
  Untrue. The using/downloading of a ROM is also copyright infringement. Has anyone been arrested? Not that I'm aware of, yet. I've seen my fair share of C&D letters though, from both sides (hosting/downloading).

Something I have wondered about though after reading an article awhile back on piracy is how much of the stuff distributed comes from internal sources? The article I read regarding movie piracy basically made the claim that a lot of the movies that get leaked online are done so as attempts at some type of corporate sabotage or attack. I have wondered about this with games also. Your competitor releases a big game and you are worried so you upload their content online to deprive them profits. This could backfire though as some kind of reverse marketing scenario haha. Thoughts? ]]>

Ironically later on when I switched to a new ISP, they accidentally assigned me a banned IP number that someone else had tainted with illegal activity. I had to call up and get them to fix me a new number. ]]>
