you are incorrect. i have discussed the item with eBay and paypal - what he is doing is "not as described" no matter how loose he is being with the language.
I guess we'll have to agree to disagree then, as I've yet to see anything presented showing that he knows exactly what it is. The creator stated they sold it for scrap, the seller apparently believed it was a prototype. You obtained it and proved otherwise, but other than your emails back and forth (which the seller really wouldn't necessarily take as gospel), there isn't anything solidly showing that he "knows" what it is. In regard to what it is, isn't it an Escape From Atlantis test cart? Escape From Atlantis shows as being copyright (ie: created by) Color Dreams right on the title screen and this test cart is on a Color Dreams board (not something you could just newly manufacture these days).
The current auction describes that cart as it is and has the seller stating that they can't say with 100% certainty what it is. He had an angry buyer telling him it was a fake proto, demanding a return/refund and providing a link to an NA thread as proof of that. I know if I had something like that come back on something I sold, I'd just shrug and roll with it but not necessarily believe what I was being sent. Remember, quite a few eBay sellers think most/all buyers are out to scam them (we certainly have enough evidence of folks speaking of that on here in various spots). Yeah, the guy technically mislabeled it the first time around, but I just don't see the evidence of foreknowledge or ill intent that you're indicating. I could be totally off base and far be it from me to defend a scumbag seller, but as bar as what's been presented, solid/absolute proof just isn't there. (shrug)
