Fake Escape from Atlantis "prototype" potentially back on the market beware!

Hi All - this cart has been discussed on this thread: http://nintendoage.com/forum/mess...

In short, the seller bought a development cart from the CIB release of Escape from Atlantis a month ago and then started selling it on eBay as an authentic prototype, claiming he had it in his personal collection for over 20 years. He was friendly and knowledgable during the transaction, but when I showed him the NA thread above and asked for a refund he took an aggressive tone with me, accused me of potentially scamming him, and, although agreeing to a refund through personal communication, tried to decline the return through the official PayPal claims process. 

As part of the return I obviously had to send him back the cart, so I want to give everybody a heads-up that this might make its way back into the market as an authentic prototype. It turns out I was the 2nd person he sold this to, the first one another NA member who doubted its authenticity.

I can update this thread with the eBay seller's user ID if the NA folks would like me to do so.

It is definitely back on the market. I messaged the seller a told him what it was a sent him a link to the thread where the maker came forward. He didn't get back to me.

There is no prototype in the title, so it is not showing up in most people's searches.

Yeah, he's trying to sell it again but has it worded such that at best it's a test cartridge and at worst he doesn't know.  I guess people who really wanted to could interpret that to mean "possible prototype," but you'd really have to want to read it that way to do so.  IMO he's in the clear unloading it this time, since it's sans chicanery.

Well, it was a test cartridge, wasn't it?  That wouldn't put it as "not as described."  NESMASTER14 literally said in your other thread, "This was a personal rough test copy I made for myself when a buddy and I released Escape from Atlantis CIB back in 2012."  The seller leaving his absolute knowledge of what the cart is hazy is probably kind of douchey, but I don't think it breaks any rules, especially since he does correctly state what the creator of that cart did--it's a test cartridge for Escape from Atlantis.  We can't really say what the seller truly knows with 100% certainty (he could very well have refused/declined to go read your prior thread on this board), as NESMASTER14 said they sold it as a scrap board.  Probably a bit of willful ignornace on the part of the seller, but still, nothing 100% provable.

I guess we'll have to agree to disagree then, as I've yet to see anything presented showing that he knows exactly what it is.  The creator stated they sold it for scrap, the seller apparently believed it was a prototype.  You obtained it and proved otherwise, but other than your emails back and forth (which the seller really wouldn't necessarily take as gospel), there isn't anything solidly showing that he "knows" what it is.  In regard to what it is, isn't it an Escape From Atlantis test cart?  Escape From Atlantis shows as being copyright (ie: created by) Color Dreams right on the title screen and this test cart is on a Color Dreams board (not something you could just newly manufacture these days).

The current auction describes that cart as it is and has the seller stating that they can't say with 100% certainty what it is.  He had an angry buyer telling him it was a fake proto, demanding a return/refund and providing a link to an NA thread as proof of that.  I know if I had something like that come back on something I sold, I'd just shrug and roll with it but not necessarily believe what I was being sent.  Remember, quite a few eBay sellers think most/all buyers are out to scam them (we certainly have enough evidence of folks speaking of that on here in various spots).  Yeah, the guy technically mislabeled it the first time around, but I just don't see the evidence of foreknowledge or ill intent that you're indicating.  I could be totally off base and far be it from me to defend a scumbag seller, but as bar as what's been presented, solid/absolute proof just isn't there.  (shrug)

when you claim to have owned something for 20 years and it's demonstrated that you bought it a few months ago that's not "technically mislabeled". As NESMASTER14 wrote, it's "full of shit". Please re-read the two threads.

I am with theinhumanwretch   this guy is full of it. He had a fake robocop prototype too. Then last week,  he tried to sell medical testing supplies. He is a real class act.
