For those of you who have not filed a chargeback, you're doing so at your own risk.  I'm locking this thread and all future sales and interest check threads from Dan until we hear confirmation that he has made good on Gwyndion's request.  Even then, he'll be on extremely thin ice until he resolves the numerous other pending sales that have still gone unfilled. ]]>

To all. Dan hired me to design the boxes/manuals/posters for Super Back to the Future 2 LE in late May. The mock-up was completed on June 19th and I sent Dan a pic of the items, which he used in this thread. A few days later we agreed upon a price. Dan said that it was fine, but that he would need to raise funds as he didn't have the cash on hand. No big deal to me, I'm a patient guy and easy going. I didn't hear from Dan until July 28th stating that he was ready to make payment. The reason I'm telling this to everyone is because Dan stated that I wouldn't be able to get the project done for a month. This is ONLY because I took on other projects for other members/people who have paid already and I'm going to give them priority. I don't want anyone to think I'm part of this delay, because ultimately this falls on Dans shoulders. Had I received an email or even partial payment I would have started the project on good faith. But a month and a half passed and there was no word. Dan said that payment was sent from his bank today, so we'll have to wait and see. Dan was at the front of the line, but simply took too long and now he's at the end. To be honest, I thought the project was scrapped after he didn't respond to anyone for so long. 

Ok enough of that, I'm a 2nd chances kind of guy. I believe in this community and what makes this community great is.... us. So lets pump the brakes for a minute and take a deep breath. 

Dan, I think Mark put it best, enough is enough. No one is asking the world of you, just some feedback. I refuse to believe that ANYONE is so busy that they cannot find 5 minutes over the course of 24 hours to update a post. Don't let this wonderful group of people down. You've got their hard earned cash, its time to put your nose to the grindstone and do right by EVERYONE.

I'm not sure what you're talking about.  He has an order in with me and I plan to fulfill it.  If he wants to request a refund I would be more than happy to do that for him, but he has not made that request yet.

Every message I send in to him seems to have several weeks before a response and I usually end up sending him several messages.  I've never posted on the HOS before and I try to give everyone a fair chance but when it comes to this guy, I don't believe he is reliable or trustworthy.  I've tried to notify everyone on the repro company list to not buy from him and I even sent him messages telling him to get this worked out with the community and myself before I put him back on the regular list and he has yet to even acknowledge or respond to those PM's.

I'm having to go through obnoxious lengths to get my money back on this and I have even requested refunds from Dan with no response which left me no other option but to contact my bank and have them pursue the claim against Dan.

Huge waste of my time, waste of the communities time, not reliable and makes promises with no follow through.  I would be happy to share my conversations and more detailed info to MrMark or another mod if interested.

So, how are you going about addressing this?
 

I am very dissappointed to hear this.    I am truly sorry for the issues that I've caused and I have no intention of defrauding anyone.  It would be hard to argue that my foray into this was anything but a mess, and the delays are my fault of which I take full responsibility for, but it is my intention to stick it out and deliver high quality reproductions to this community.   I see now that it will be an uphill climb to repair the damage that I have caused to my reputation, but I plan to do my best to earn back this communities trust.  You guys deserve better than what I've given you, but I hope that I can exceed your expectations in the future.

While gwynidion has contacted me a few times regarding my unfortunate delays, after a search of both my PM and email inbox I can safely say that I have no record of him asking me to cancel his order or asking for a full refund.  He did request a partial refund because he forgot to use the discount code that I had offered to the community, which I did submit to my processor, but that is the only record I have of any such request.  Again, if he wants a full refund he can request one, and while disappointing, I will get that taken care of right away.

I have sent payment for the boxes and manuals, and though it was late (due to my paypal accounts being frozen) I fully intend to continue my professional relationship with NES-City and to fully compensate him for this fine work he did on this project. Dan,

Glad to see you are coming back and haven't disappeared.

I don't like dealing with issues like this from resellers.  It's been mixed responses and promises without delivery.  I know you have told people you have had family problems which has caused some of these issues but there is no excuse for not responding to the community.

Frankly, I'm very disappointed to say the least.  I still haven't received a PM from you whatsoever and since you only seem to respond via threads, I would like to publicly request my funds back.  I highly recommend you stay in touch with people since you don't accept payment through paypal and banks are MUCH more severe in their reactions to claims then paypal is.

I appreciate you acknowledging where you have made some mistakes to the community and until all of the complaints I have received from people (which are from several of your customers) and I see a consistancy from your future sales, I will still keep you on the "buyer beware" list for repro makers.

repro making is a small community and you have to be diligent about the work you do.  There is a higher standard held for those that run a business then those that just do repros sometimes for themselves and people who need them.

So please refund my money and in the future you need to respond to PM's from myself as well as others. ]]>

I am happy to hear everything is okay and I will be expecting my game eventually (take your time) but I have to say that you definitely need to keep people updated. I, myself, have started making some repros and boxes etc just to test the waters, and I understand that it is really, really difficult getting started, but I am sure nobody here will be bothered or offended by tardiness as long as you keep them posted. Good luck with everything, hope you don't get HoS'd and everything - and as long as you keep your word with my LE copy - I will repeat business. ]]>
